1. Agreement

MyMagicalStory is operated by a family-run Australian business ("we", "our", "us"). By using mymagicalstory.com ("the Service") you agree to these terms. You must be at least 18 years old to create an account. If you don't agree with these terms, please don't use the Service.

2. The Service

We create personalised children's storybooks: you provide photos and details of your child (and, for some stories, other family members or pets), and we generate a storybook in which they are illustrated as the star. The Service includes:

• Story templates you can personalise, and (for subscribers) fully custom stories
• Free previews so you can see the book before paying anything
• Printed softcover and hardcover books, produced locally in Australia, the US, the UK, New Zealand and Canada
• A digital copy of every purchased book, kept in your account's library

Illustrations are generated by automated technology from your photos and choices. Every book is made to order and unique; small variations between preview and final print (colour, cropping) can occur.

3. Plans and pricing

Prices are shown and charged in your store's currency and may change; changes never affect an order you've already placed, and subscription price changes take effect from your next billing period after notice. Unused monthly books don't roll over.

4. Payments

Payments are processed securely by Stripe — we never see or store your card details. You agree to provide accurate billing information and authorise the charges for your purchases and subscription. Prices include or exclude taxes as shown at checkout, and any applicable taxes are collected there.

5. Printing, shipping and delivery

• Books are printed locally in each region we serve — no international shipping fees or customs delays
• Standard shipping: Free · Express shipping: $7.99
• Production takes about 4 business days before dispatch; delivery estimates shown at checkout are estimates, not guarantees
• For books bought from a preview, we generate the full book and ask you to review and approve it before it's sent to print — you can regenerate individual pages you're not happy with (up to 3) at this stage
• Please double-check your shipping address; we can't redirect a book once it has been dispatched

6. Our guarantee, cancellations and refunds

• Quality guarantee: if your printed book arrives damaged, defective, or you're simply not satisfied with the print quality, contact us within 30 days of delivery and we'll reprint it or refund you.
• Before printing: for preview purchases awaiting your approval, you can contact us to cancel for a refund any time before you approve the book for print.
• After printing: each book is personalised and printed just for you, so we can't accept change-of-mind returns once printing has begun — the quality guarantee above still applies in full.
• Subscriptions: cancel any time from your account; you keep access until the end of the paid period. Books already generated stay in your library.
• Your statutory rights — including the Australian Consumer Law consumer guarantees and equivalent protections in the UK, NZ, Canada and the US — are not limited by anything in these terms.

7. Your content

• You keep ownership of the photos and details you provide.
• You grant us the licence needed to create, store, print and deliver your books — that's the only thing we use your content for. See the Privacy Policy for how photos are protected.
• You confirm you have the right to upload every photo — for photos of children, that you are their parent/guardian or have their parent's or guardian's permission.
• Your finished books are for personal, non-commercial use — enjoy them, gift them, just don't resell them.

8. Acceptable use

You agree not to:

• Create content that is illegal, harmful or inappropriate for children
• Upload photos or material you don't have the right to use
• Attempt to gain unauthorised access to our systems, or interfere with the Service
• Use the Service to build a competing product or resell generated content commercially

We may suspend or close accounts that breach these terms; you'll keep access to books you've paid for unless the breach involves those books.

9. Our intellectual property

The platform, story templates, artwork styles, branding and technology remain our intellectual property. Purchasing a book gives you the personal-use rights described above, not rights in the underlying templates or technology.

10. Liability

To the extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the order or subscription giving rise to the claim, and we are not liable for indirect or consequential losses. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

11. Changes to these terms

We may update these terms as the Service evolves. Material changes will be flagged on the site or by email, and the date above always shows the current version. Changes apply from the date they're posted and never retroactively to orders already placed.

12. Governing law and contact

These terms are governed by the laws of South Australia, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts — this doesn't affect your right to rely on the consumer protection laws of the country you live in. Questions about these terms:
